The Need for Long Term Disability Coverage

Your individual long term disability (LTD) insurance is supposed to provide benefits when an injury, illness, or other disabling condition results in your inability to work. A variety of physical and mental conditions may trigger coverage under a long term disability insurance policy, including:

  • Physical injury (work-related injury, personal injury )
  • A prolonged illness
  • Mental illness (depression)

The financial and emotional burdens resulting from a long term disability claim denied in bad faith can be devastating to you and your family and leave you with few, if any, options to put your life back together. Our attorneys offer compassionate and resourceful legal services to clients nationwide to obtain fair and full recovery of wrongfully denied individual long term disability benefits.

We help individual long term disability insurance policy holder, public sector employees, and employees of religious institutions whose LTD claims have been denied to prove the existence and nature of your disability and vigorously pursue the financial recovery to which you are entitled. You recovery may included punitive damages in addition to the compensation for your other bills.

There is virtually no way around the expense of long term care. The vast majority of adults over the age of 65 will at some time require long term medical treatment, personal care, or both. Long term care insurance is intended to ensure the required healthcare, personal, and support services are available to individuals who have degenerative diseases, prolonged illnesses, cognitive disorders, or other conditions resulting in deteriorating health, including:

  • Parkinson's disease
  • Strokes
  • Cancer
  • Alzheimer's disease

The Need for Long Term Care Insurance

The annual cost of long term care ranges from approximately $40,000 to over $100,000. People purchase long term care insurance with the understanding that they will be covered or reimbursed for this expense. However, insurance companies regularly deny claims and cancel policies. When the person you love needs assistance with daily living or supervision, who pays? We have sophisticated strategies and ideas that allow us to pursue recovery for our clients' expenses. We understand the emotional and financial impact the denial of a claim or cancellation of an individual LTC policy can have on your entire family. We offer prompt services with the ultimate goal of recovering for you.

The denial of a health insurance claim leads many people down a path of financial troubles. The lack of affordable health care in our nation should be buffered by health insurance policies. When individual health insurance claims are not paid or when claims are denied, the expenses catch up to the insureds.

Deceptive marketing practices of health insurance companies can cause financial crisis, affecting people's credit and well-being. We offer experienced and resourceful legal services to clients nationwide to pursue recovery for individual health insurance claims that were denied or cancelled in bad faith. With over 60 years combined experience, our attorneys have developed strategies and ideas to secure favorable outcomes for our clients.

We are advocates--speaking out for our clients and pursuing justice. Although most cases settle, we are experienced trial lawyers who prepare each case as if for trial. We help clients who encounter problems with their individual health insurance providers, including Blue Cross, Blue Shield, Pacificare, Aetna, UnitedHealthcare, Mega Life, and Kaiser Permanente. Facing an injury or illness is serious enough. Your health insurance company is supposed to help you through your health problems--not contribute to them.

Do not waive your rights as a consumer. When an insurance company acts in bad faith, it places severe financial burdens on the individuals and businesses who are entitled to compensation for their injury or loss. If you are the victim of bad faith insurance practices, our attorneys will vigorously pursue your claim, work to prove that the insurance company's refusal to pay your claim for the full amount was "unreasonable and unfounded," and fight to protect your right to be compensated fairly and fully. When appropriate, our insurance lawyers work with insurance experts and other lawyers and law firms to pursue the best results possible for your situation.

You have a right to compensation. People who purchase insurance policies or file claims have a right to compensation from the insurance company in the event of an occurrence covered under the policy. However, insurance companies sometimes act in bad faith and wrongfully deny claims, delay payments, or cancel policies in breach of their duties of "good faith and fair dealing." Claim denials resulting from error, misinterpretation of policy terms, fraud, or for other reasons can be the basis for a bad faith insurance claim.

Bad faith insurance claims can arise in any type of insurance policy, including

  • Life insurance claim denials
  • Individual long term disability insurance claim denials
  • Individual long term care insurance claim denials
  • Individual health insurance claim denials
  • Homeowners' insurance claim denials
  • Business insurance claim denials (business interruption, casualty insurance)
  • Natural disaster claim denials (tornado insurance, hurricane insurance, flood insurance, etc.)
  • Fire insurance claim denials
  • Motor vehicle accidents
  • Motorcycle and bicycle accidents

We help people injured in auto accidents and their families. Here's How:

There is an insurance company on the other side. Insurance companies have batteries of claims adjusters and lawyers whose job is to try to avoid paying, to hold down the amount they pay, and to save the insurance company money.

Getting the right law firm on your side is vital. If you, or a family member, were injured in a motor vehicle accidents (car accident, truck accident, SUV rollover), motorcycle or bicycle accident, or other accident, the right law firm is especially important. The last thing you want is to have the party, who caused the injury, and its insurance company, cheat you and your family out of the recovery to which you are entitled. Yet which lawyer should you choose? We can help.

We understand how insurance companies operate. Our lawyers and staff have decades of experience dealing with insurance companies and the lawyers who represent them. We know the tactics they use, how to stop them from playing games and how to get results for our clients - through settlement or litigation. Insurance companies know we do.
